AES Fails to Return Overpayments


I recently had a conversation with an AES supervisor about the payoff of my law school loans. She gave me a final payoff figure that corresponded to the amount of the final payment due if my electronic bank transfer was completed in two days. I told her that I would have my bank do the transfer that very day. I asked her what happens if AES receives and processes my final payment a day early. How would my overpayment be handled? She told me that if the overpayment is more than $5.00, I would receive a reimbursement check from AES. But, if the overpayment is less than $5.00, AES would keep it.

If anyone has had this experience, I would very much like to talk with you. I am a class action attorney in California investigating claims against the company.

I have had all kinds of issues with AES including their loans not being able to be included in Student Loan Forgiveness. I can no longer pay on them. Any help about a class action lawsuit would be appreciated.

As someone who is a hair's breadth away from pursuing formal FTC and FCC claims against AES for breach of the FDCPA, I would very much like to know if you do pursue a class action suit.

I have instructed AES as well as NCT and DCS repeatedly that I am not allowed to receive collection calls at work. Despite this, AES contacts me at my place of work every time my account is more than 16 days delinquent, and forwards my work contact information (which was supposedly deleted after the most recent incident) to NCT and the collection agencies. I have been making good-faith payments since my forbearance ran out two months ago, but AES isn't content with that amount.

What can be done to stop companies like AES from stomping all over the little guys, particularly when the White House's announced reform plan has no provisions for those of us who already mortgaged our future on student loans?

i was wondering if your class action claim on aes was going any where? i am having an issue with them and i think a lawyer is probably the only way to go. i have been watching my bills and payment from them very closely for the last few month (after reading some very scary reviews about them) and i have noticed that when i make a payment my unpaid interest either goes down for part of my payment or will increase. but it shows that my whole payment went to interest. i have called them about this and when i was explaining it to the cr he was totally baffled by what i was saying and then he was getting very rude about it. he also told me that my unpaid interest for the year was set at the beginning of the year and does not go up or down at all during the year. so i asked that he send me a copy of everything, including all my unpaid interest totals for every month since i started paying back my loan. he agreed but when i got the copy they sent all it had on there was what i paid and when i paid it. there was something very unsettling about this so since then i have been printing off my online account records of everything including my unpaid interest balance, and thats when i really started noticing that something was very wrong. because every payment i made, even though it showed that the whole payment went to interest my unpaid interest balance would only go down for part of my payment. and the last time i made a payment my interest actually went up. i dont know what to do any more cuz i feel like im being robbed and dont know where to go.
